This page has our terms and conditions on which we supply our products and services. Please read these terms and conditions carefully before ordering any products from our site or engaging with our service. By accessing our site and placing an order with us, you have agreed to be bound by these terms and conditions and terms. 

    1. Foodieshomedelivery.com.au  is registered under Foodies Home delivery, ABN 34643094580.

FOODIES Home Delivery is a family owned and operated business by people who actually live in the Berry and Bomaderry area. 

By creating a safe and high quality delivery system for the local area we are able to add value to the lifestyle of anyone who needs food services in the evenings 7 days per week.


3.1. Foodies Home Delivery offers an evening delivery service in the area which is currently around an 8km radius from Berry town centre, 7 days a week. If you live outside the delivery areas, we will email you upon receipt of your order and arrange a refund. Foodies has plans to include Gerroa, Gerringong, Nowra and Kiama as soon as possible. 

4     ORDERS

4.1 When you place an order through our Service, an email thanking you for your order and confirming your order will be received and accepted (the “Confirmation Email”)and will be emailed to you. The contract will be between you and Foodies Home Delivery and will only be formed when you have been presented with the Confirmation Email. We may reverse this should the orders have time constraints or you are located outside of our service area. Please ensure that you have provided us with your correct email address as this is how we will communicate with you about your order. Please also ensure that you provide an accurate address and telephone number to assist Foodies Home Delivery to provide a quality service.

4.2 We may use nuts in the preparation of certain meals and our kitchen is not ‘nut free’. Please contact us prior to ordering if you have an allergy. We cannot guarantee that any of the meals we provide are free of allergens.


5.1 Our aim is to provide the best product and service possible. Delivery of service will be based on contractual agreements. Unfortunately, things do not always go to plan and factors such as traffic conditions and weather, may occasionally prevent us from achieving our targets in this regard. We will do our best to ensure that your meal is delivered by the time specified in the email. The timing of your order is determined by taking into account the number of orders and the circumstances being faced at that time.

5.2 Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation. It is the customer’s responsibility to make sure someone is available to receive their food order on specified delivery date.
5.3 Delivery dates/windows stated by Foodies Home Delivery are an indication and not a guarantee of delivery within these days/hours.

5.4 Delivery will be completed when we, or our authorised courier company, deliver the Products to the address you gave us. If no one is available at your address to take delivery, we, or our authorised courier company, will follow the delivery instructions provided to us by you. If no additional instructions are specified, the order will be left in an area that the authorised courier considers appropriate. We will endeavour to follow any delivery instructions you provide but this cannot be guaranteed.

5.5 Foodies Home Delivery will not attempt a further delivery. You are obliged to bear all expenses related to aforesaid default of acceptance.


8.1 We make no representation or warranty of any kind, express or implied, regarding the content or availability of our Service, or that it will be timely or error-free, that defects will be corrected. We shall not have any liability to you for any direct, indirect, special or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of or your inability to use our Service. In the event that we are found to be liable to you, our total aggregate liability is limited to the purchase price of the meals you have paid for in your order. This does not include or limit in any way our liability for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.


9.1 No party shall be liable to the other for any delay or non-performance of its obligations under this Agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, pandemic, war, fire, flood, explosion or civil commotion. For the avoidance of doubt, nothing not included in clause 9:1 shall excuse the Customer from any payment obligations under this Agreement.


10.1 Neither you, nor Foodies Home delivery shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, pandemic, fire, flood, explosion or civil commotion.


11.1 If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.
